WARRANTY AND EMISSIONS DISCLAIMER

The performance parts purchased from HPAP, Inc. are designed and intended for off road/highway use only. Use of the above vehicle on public roads may violate State and/or Federal laws and regulations relating to motor vehicle safety standards including State and/or Federal emissions laws and regulations. Federal and State laws prohibit removal, modification or rendering inoperative any part of a vehicle emission control system. Installation of these parts may void manufacturers and/or extended warranty coverage of the vehicle. HPAP, Inc. makes no claims to the legality of any parts used for “on road/highway vehicles.” Customer further agrees to indemnify and hold harmless HPAP, Inc. from any claims or liability arising from the sale or installation of the performance parts at the request of customer. Customer warrants that he/she accepts all legal responsibility for any modifications performed on the above-described vehicle. Customer agrees that the modifications performed on the above-described vehicle are for off road/highway use only. Customer further warrants that he/she has willingly entered into this agreement and agrees to be bound to this agreement. Customer shall not be entitled to recover from HPAP, Inc. any consequential damages, damages to property, damages for loss of use, loss of time, loss of profits, or income or any incidental damages. HPAP, Inc. disclaims all warranties, either express or implied, and neither assumes nor authorizes any other person to assume for it, any liability in connection with this sale.

THESE PARTS ARE LEGAL FOR USE ONLY IN COMPETITION RACING VEHICLES AS DEFINED UNDER CALIFORNIA LAW, AND ARE NOT LEGAL FOR USE IN ANY OTHER MOTOR VEHICLE. California law defines a “racing vehicle” as “a competition vehicle not used on public highways.” (Calif. Health & Safety Code 39048) These parts may only be used on competition racing vehicles operated exclusively on a closed course in conjunction with a sanctioned racing event. Competition-only motor vehicles may not be driven to a racing event on a public highway and must be transported on a trailer or other carrier. USE OF THESE PARTS IN ANY OTHER VEHICLE MAY SUBJECT YOU TO FINES AND PENALTIES FOR VIOLATION OF FEDERAL AND/OR STATE LAW, WILL VOID YOUR WARRANTY FROM Vargas Turbocharger Technologies, Inc. , AND CAN VOID YOUR VEHICLE’S WARRANTY. It is your responsibility to comply with all applicable federal and state laws relating to use of these parts, and Vargas Turbocharger Technologies, Inc. hereby disclaims any liability resulting from the failure to use these parts in compliance with all applicable federal and state laws.

CUSTOM PRODUCT POLICY
Any HPAP, Inc. products built to order, such as turbochargers, manifolds, turbo kits, etc, require a 50-100% NON-REFUNDABLE deposit for the order to be placed. This policy is in place due to the custom nature of each product, and HPAP, Inc.’s inability to sell the product if the buyer decided the product is unwanted. If HPAP, Inc. does agree to a refund on a custom product there will be a restocking fee which varies by product.

COMPONENT WARRANTY

All components manufactured by, or sold under the HPAP, Inc. brand, hold a 12-month warranty against defects in materials and workmanship. Warranty is intended to cover components only when they are used in the manner for which they were originally designed. Warranty is void on all products found to have been used in racing or off road applications, or any nature whatsoever, on all products that show evidence of abuse, lack of proper maintenance, improper installation, misapplications, alteration in any way whatsoever from their original design or negligence in the use of  HPAP, Inc. products by the original retail purchaser or by any agent of the original retail material. Warranty applies to original purchaser only, transfer of ownership, or sale of items to a 3rd party will void all warranties. These warranties specifically excludes, but is not limited to, any normal maintenance and wear items such as belts, brake pad material, clutch disc friction material, and brake rotors. HPAP, Inc. accepts no responsibility for any costs or grievances incurred by failure of parts; including but not limited to labor and shipping costs to and from HPAP, Inc.

All third-party products (not manufactured by HPAP, Inc.) are covered by their respective manufacturer’s warranty.

SERVICE WARRANTY

All work warranted against defects in workmanship for 10,000 miles or 12 months; whichever occurs first. No warranty provided on failures caused from defects in customer supplied parts. No warranty on any items or work found to fail due to abuse, neglect, racing, or any scenarios considered outside normal driving conditions. Some modifications may void portions of the factory warranty. HPAP, Inc. is not responsible for any costs incurred by customer due to factory warranty refusal. Not responsible for any costs or damage incurred to vehicle, persons, or other property as a result of any work performed by HPAP, Inc.

PROCEDURES FOR WARRANTY CLAIMS

In the event a problem occurs with a HPAP, Inc. component, please contact HPAP, Inc. at sales@mbs-performance.com during normal business hours. When speaking to a customer representative, you will need to have your invoice number on hand. The following steps will then be followed:

  • 1. HPAP, Inc. representative will determine if the product will have to be returned to HPAP, Inc. for inspection. A RMA number and the Return Address will be given, which needs to be placed clearly on the shipping label.
  • 2. The retailer or the customer will ship the component in question back to HPAP, Inc. including the original receipt, if it is a turbocharger, warranty card and a clear description of the exact problem experienced. It is the responsibility of the retailer or the customer to pay for shipping back to HPAP, Inc.
  • 3. Tuning documentation must be submitted to HPAP, Inc. including tuner used, logs showing boost level at the time of failure, etc
  • 4. If HPAP, Inc. finds the component to be defective and within the warranty period, HPAP, Inc. will repair, replace, or issue credit to the customer at HPAP, Inc.’s option. Any repaired or replaced product will be returned to the retailer or customer, UPS Ground, FedEx Ground, USPS or by
    Truck. Please note that no replacement warranty parts can be shipped until original parts are returned to HPAP, Inc. for inspection.

RETURNS

In the event that a component must be returned (some products are non-returnable), please contact a HPAP, Inc. customer representative for a Return Merchandise Authorization (RMA) number and the Return Address. The RMA number must be placed clearly on the shipping label. Any returned products without a RMA number will be refused. No returns accepted after fourteen (14) days from ship date shown on Invoice. There is a 20% restocking fee applied to all components returned in a 100% resalable condition. If returned components are not in a 100% resalable condition, an additional charge will be assessed at the amount decided by HPAP, Inc. If component(s) are damaged, or show signs of installation, the return will not be allowed. All returned goods must be shipped to HPAP, Inc. by prepaid freight. We highly recommend insuring any items shipped to HPAP, Inc. for return. Special Order parts are not returnable. 

Cancellations
If you would like to cancel your order, you can do so provided that the order has not yet been shipped. If the item you want to cancel has been assembled or pieced together and is boxed ready for shipping, a restocking fee may apply. If the item you want to cancel has shipped, the order cannot be canceled. However, you can return the item for a refund. See our Return policy.
